Le présent amendement rappelle qu’un discernement gravement altéré ne permet pas de considérer la manifestation de volonté comme libre et éclairée.
Il souligne toutefois la difficulté d’apprécier la gravité d’une altération du discernement, ce critère restant largement subjectif et susceptible de varier selon les évaluations cliniques.
