Mais comment apprécier la gravité d’une altération du discernement ?
En quoi une simple altération du discernement permettrait-elle de s’assurer du caractère libre et éclairé de celui-ci ? Ce critère de la gravité de l’altérité du discernement est éminemment subjectif.
