Après l’article L. 253‑8 du code rural et de la pêche maritime, il est inséré un article L. 253‑8‑1 A ainsi rédigé :
« Art. L. 253‑8‑1 A. – L’utilisation des produits phytopharmaceutiques contenant la substance active bromuconazole est interdite à compter du 1er janvier 2026. »
Exposé sommaire
La substance « bromuconazole » relève de la catégorie des CMR (cancérigène, mutagène, reprotoxique).
Elle est classée « H361d : susceptible de nuire au fœtus ».
Les pesticides composés de cette substance ne doivent donc pas être autorisés en raison des risques pour la santé humaine.
De plus, cette substance figure sur la liste de celles dont la substitution est envisagée conformément à l'article 24 du règlement européen. Elle présente en effet deux des trois critères prévus pour être considérée comme une substance PBT, c'est-à-dire persistante, bioaccumulable et toxique. Ses dangers sont donc notoires.
